1. Acceptance of terms

By accessing or using the Our Yes Day website and services ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

2. Description of service

Our Yes Day provides an application for creating, customizing, and sharing digital wedding invitations. Features include:

• Design tools for creating personalized wedding invitations.
• Online RSVP collection and guest management.
• Invitation hosting accessible via a shareable link.

Invitations can be created and designed for free. A one-time payment is required to publish and share your invitation with guests.

3. Account registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete registration information.
• Maintain the security of your account credentials.
• Promptly notify us of any unauthorized use of your account.
• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that are used in a manner we deem harmful to the Service or other users.

4. Content and intellectual property

Your content

You retain ownership of all content you upload or create through the Service, including text, photos, and other media ("Your Content"). By uploading Your Content, you grant us a limited, worldwide, royalty-free license to host, display, and distribute it solely as necessary to provide the Service (e.g., displaying your invitation to guests you share it with).

You represent that you own or have the necessary rights to Your Content and that it does not infringe the rights of any third party.

Our content

The Service itself — including its design, templates, themes, code, graphics, and trademarks — is owned by Our Yes Day and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without our express permission.

5. Acceptable use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Upload content that is unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
• Impersonate any person or entity, or misrepresent your affiliation.
• Interfere with or disrupt the Service, its servers, or networks.
• Attempt to gain unauthorized access to any part of the Service.
• Use the Service to send spam, unsolicited communications, or conduct phishing.
• Collect or harvest information about other users without their consent.

We reserve the right to remove any content and terminate accounts that violate these terms, at our sole discretion.

6. Guest data and privacy

When guests submit RSVP responses through your invitation, you are responsible for:

• Informing guests that their data will be processed through Our Yes Day and directing them to our Privacy Policy.
• Using guest data only for purposes related to your wedding event.
• Complying with applicable data protection laws when handling guest data exported from our Service.

7. Third-party services

The Service may integrate with or link to third-party services and infrastructure providers. By using the Service, you acknowledge that certain features rely on third-party providers, each governed by their own terms and privacy policies. We are not responsible for the content, practices, security, or availability of these third-party services.

Our current third-party providers include:

• RevenueCat: payment processing and purchase management.
• Google: authentication and login services.
• Apple: authentication and login services.
• Turso: database hosting and infrastructure.
• Cloudflare: website hosting, server infrastructure, security, and content delivery.

Your use of these third-party services is subject to their respective terms, conditions, and privacy policies.

8. Limitation of liability

To the fullest extent permitted by law, Our Yes Day and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

• Loss of data, revenue, or anticipated savings.
• Service interruptions, downtime, or errors beyond our reasonable control.
• Any decisions or actions taken by guests based on information in your invitation.

Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

9. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

We make no guarantees regarding the availability, accuracy, or reliability of the Service or any content within it.

10. Indemnification

You agree to indemnify and hold harmless Our Yes Day and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your violation of these Terms.
• Your use or misuse of the Service.
• Your Content, including any infringement of third-party rights.

11. Termination

We may terminate or suspend your account at any time, without prior notice, if:

• You breach any provision of these Terms.
• Your account remains inactive for an extended period.
• We discontinue the Service or a feature you are using.

You may delete your account at any time through your account settings or by contacting us. Upon deletion, Your Content and associated data will be removed from our systems within a reasonable timeframe, subject to backup retention policies.

Provisions that by their nature should survive termination — including those relating to intellectual property, limitation of liability, and indemnification — shall survive.

12. Governing law

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Czech Republic.

13. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Our Yes Day regarding the use of the Service, superseding any prior agreements or communications.

If you access the Service through an Apple application, the Apple Standard End User License Agreement also applies.

14. Changes to These Terms

We may update or modify these Terms from time to time to reflect changes to the Service, applicable laws, or our business practices. When we make changes, we will update the “Last Updated” date at the top of these Terms.

You are advised to review these Terms periodically for any updates or changes. Continued use of the Service after updated Terms become effective constitutes your acceptance of the revised Terms.
